Latest development on the case of Soh Sook Hwa vs Menteri Pengajian Tinggi

Soh Sook Hwa was a student in USM back in 2004. She had involved herself in the election campaign for a oppositin candidates and as such, was found guilty and fined for violation of Section 15 of the University and University College Act 1971.

Soh then seeks to file an application for leave to judicially review Section 15(1)(a) of the 1971Act as it is arguably unconstitutional. However, in 2010, the application was dismissed by the High Court on the ground that the particular section has been amended. An appeal had been filed to be heard by the Court of Appeal.

Although Section 15 has been amended, such amendment is merely cosmetic. It still, in essence, prohibits the students from exercising their civil rights to political participation and freedom of speech. It is contrary to the spirit of democracy.

There is also double standard on the part of government in enforcing the prohibition. While the government claims that it is for the benefit of students not to involve in political activities, it is the government that allows brainwashing forums such as that which was held by Suara Wanita 1Malaysia in UUM.

As a direct result of this, our universities have been producing graduates who have lose their ability to think and analyse independently. They are fearful of voicing out opinions that may be unfavourable to the interest of the authority. They become uninterested in social issues and nation building.

It is a fact that foreign universities that enjoys higher degree of freedom are producing graduates that are more creative, innovative and socially aware. We urge the public to attend the court hearing to support the demand for the abolishment of UUCA. The details of the hearing are as below:

苏淑桦挑战《大专法令》违宪案有最新进展,2月20日,上午9:30am,在布城上诉庭进行上诉。

吁请各位公众抽空前往法庭给予支持,支持苏淑桦与一众学运分子一路走来,废除大专法令的立场。

苏淑华2004年因在大选参与助选而遭理大校方援引《1971大专法令》提控,当时仍是理大学生的她被判罚款200零吉;由于不满校方判决而上诉至高教部,但高教部却驳回上诉。随后苏淑桦继续入秉法庭,起诉《大专法令》第15(1)(a) 条文违宪,并申请对高教部的决定进行司法复核。此案拖延至2010年,结果吉隆坡高庭基于《大专法令》第15条文已经修改,而驳回司法复核的要求,同时宣判苏淑桦必须支付堂费3000零吉。

大专法令横行42年,违反民主基则的条文扼杀了学生的宪赋公民权利,包括公民的政治参与权、言论自由、结社自由。从上而下的大学官员委任制更令校园顿失民主、和学术自由之主权。在学生事务的主权方面,学生代表理事会委于官僚指令之下,沦为没有实权的传声筒,专门办文娱活动、激励讲座,有者更沦为没有公民意识,痴盲为高官叫阵的傀儡。校园不民主,国家就不会有民主。

虽然第15条文已经修改,然而仍然不允许学生“将政治带入校园”。反观,校方频频邀请执政党人士进入校园,大开门户,公然进行洗脑操作。北大“一个大马女性之声”(SW1M)的洗脑论坛,理大 “Jelajah 1 Malaysia, Janji Ditepati” 国庆日活动—— 例子不胜枚举。显然只许州官放火,不许百姓点灯,严重侵害了校园社群的知情权、获取多方面资讯与知识的自由,校方一味的灌输单向资讯。结果学生们变成脱离社会感受、没有政治观感、缺乏社会分析能力、同时欠奉批判能力的一群、对社会疾苦选择性失明。到最后这一群社会培育的大专生,眼里只顾着未来的专业前途,软软绵绵,习惯施舍式的慈善活动,而不愿意付出未知代价去谈论促进整体平等的制度改革。

第15条文虽只是恶法的冰山一角,然而牵一发而动全身,大专法令是马来西亚铁腕独裁政权独有的产物,此恶法有必要马上废除。事实证明,若依据全球大专排名,许多国家的大专比我们的大学培育出更有创意、视野、学术涵养的学生,他们并没有钳制大学与学生主权的法令。甚至是1960年代的本地大学院校,也比今日有更开放、民主、自由的风气。

马来西亚青年与学生民主运动(学运)吁请各位公众到法庭出席聆审。表达追求公义、废除恶法的决心,阻止贪腐的黑手掌控校园这一片知识的土壤,同时也让年轻的学子们醒悟于自己作为一个独立自由者的尊严和权利,不让更多人成为《大专法令》洗脑霸权直接或间接的受害者,做一个拥有独立思想、有能力捍卫平等、自由和民主的人。
