Beberapa puluh mahasiswa dihalang daripada menyertai forum yang membincangkan pindaan Akta Universiti dan Kolej Universiti (AUKU) di Universiti Kebangsaan Malaysia (UKM) malam tadi.

Mereka dilarang masuk oleh pengawal keselamatan kerana tidak mematuhi kod pakaian pelajar universiti berkenaan dan tidak menggantung kad pelajar masing-masing. Forum tersebut hanya untuk pelajar UKM sahaja

Sebahagian daripada mereka yang terdiri daripada pelajar UKM, dibenarkan masuk kemudiannya selepas mereka balik menukar pakaian.

[Malaysiakini] Anwar gets BIGGER majority

9.50pm: Official EC tally - Anwar Ibrahim got 31,195 votes, Arif Shah Omar Shah, 15,524, Hanafi Hamat, 92. Anwar won with a majority of 15,671.

Anwar’s wife, Dr Wan Azizah Wan Ismail, won the seat with a 13,398 majority at the March 8 general election.

The official voter turnout was 81.01 percent. There were 58,459 registered voters. The final voter turnout figure was much higher than what the EC had stated earlier today.

There were 447 spoilt votes and 98 unreturned ballot papers.

The turnout today is slightly higher than March 8.

[Malaysiakini] Permatang Pauh by-election

9.25pm: Official EC results - With final five ballot boxes to go, Anwar Ibrahim has bagged 29,526 votes, Arif Shah Omar Shah (14,444) and Hanafi Hamat (89). Majority so far: 15,082.

9.12pm: Official EC results - With 11 more boxes to go, Anwar Ibrahim has won the by-election with a 14,551 majority. He garnered 27,977 votes while BN’s Arif Shah Omar Shah obtained 13,426 while Akim’s Hanafi Hamat got 85.

8pm: Unofficial results - Anwar Ibrahim wins with a majority of 16,210 votes. He garnered 26,646 votes while Arif Shah Omar Shah got 10,436.

However, PKR unofficial results – Anwar wins with a majority of 17,652, obtaining 31,949 votes. BN’s Arif Shah garnered 14,297 while Akim’s Hanafi Hamat got 74. Hanafi to lose his RM15,000 deposit. This figure would mean 46,320 voters cast their ballots instead of the EC’s 38,144.

Sombre rally against UUCA amendments

Dressed in all black, scores of students staged a sombre protest in the rain outside the entrance to the Parliament building this morning.

They were there to voice their displeasure over the proposed cosmetic changes to the Universities and University Colleges Act (UUCA) which they wanted abolished completely.

Representing 13 student organisations, they came armed with banners, placards and even a mock corpse wrapped in a burial shroud to symbolise the ‘death of universities’.

To stress the point further, the students also lied down on the road under the watchful eyes of a group of anti-riot and general duty police personnel.

Tempers began to flare when police personnel attempted to seize the banners and placards from the students. Finally, calm was restored when the student leaders agreed to disperse upon submitting a memorandum.

Minutes later, a ministry official arrived to talk to the students. The students were told to calm down and engage the appropriate channels to communicate with the minister.

According to the official, the students should have just sent five representatives to see the minister and not stage a demonstration.

The students responded that their grievances have been made known to the minister for the past two months, but has yielded no results.

Eventually the stalemate was resolved with the official agreeing to allow five representatives to enter Parliament and submit their memorandum to Deputy Higher Education Minister Idris Haron.

Give us the freedom’

Although they initially planned to submit their memorandum to minister Khaled Nordin, Abolish UUCA Students Movement’s representative Ridzuan Mohammad was however satisfied with the outcome.

“Students should be given the freedom to voice out their opinions regarding any political issue in and out of the country.

“However, we appreciate the fact that the deputy minister is here to accept the memorandum from us and is willing to listen to our heartfelt concerns,” he told reporters in the presence of Idris.

Ridzuan stressed that students expect both the ruling Barisan Nasional and opposition Pakatan Rakyat MPs to debate the amendments intensely and fairly.

According to him, the UUCA should be replaced by a more contemporary law.

Meanwhile, Idris said students were welcomed to come to Parliament to witness the debate on the proposed amendments for themselves.

“So the students will be able to judge whether or not the debate is one-sided. However, we have to wait for the debate date to be fixed first,” he added.

Among others, the amendments once passed would see students facing disciplinary action instead of prosecution if found to be involved in political parties or unlawful organisations.

Other latitudes of the altered act also allows for the enrolment of politicians for courses in universities without having to sacrifice their political career with the discretion of the vice-chancellor of the university.

However, detractors have called for the restrictive law to be abolished completely.

Kira-kira 300 pelajar kejururawatan di Kolej Masterskill di Cheras, Kuala Lumpur mengadakan demonstrasi membantah tindakan Perbadanan Tabung Pendidikan Tinggi Nasional (PTPTN) yang didakwa memotong jumlah pinjaman mereka.

Mereka berhimpun mulai jam 10 pagi di dalam kawasan kampus sambil melaungkanr rasa tidak puashati mereka terhadap tindakan PTPTN itu.

“Masalah di universiti, penguasaan golongan pentadbir yang lebih senduk daripada kuah,” kata pensyarah kanan di jabatan sains politik Universiti Kebangsaan Malaysia (UKM) Dr Ahmad Nidzamuddin Sulaiman hari ini.

“AUKU tidak apa. (Persoalannya) pegawai yang cenderung kepada parti (kerajaan) berubah atau tidak?”

Beliau menambah, kebebasan di universiti tidak bergantung kepada pindaan AUKU, sebaliknya “sebahagian pentadbir yang prokerajaan mengambil sikap mengawal aktiviti pelajar dan pensyarah”.

Dr Ahmad Nidzamuddin memberitahu Malaysiakini, jika pentadbir institut pengajian tinggi awam (IPTA) tidak bersikap memihak, kebebasan kampus akan lebih baik.

政治的偷窥者

【少不更事/黄洁媚专栏】19世 纪的著名民主革命家和教育家蔡元培,就任北大校长时说:“大学者,研究高深学问者也……诸君须抱定宗旨,为求学而来,入法科者,非为做官;入商科者,非为 致富”。他也实行教授治校,还原大学的面貌。象牙塔,从观念与组织上而论,必然要摆脱国家官僚机构与政治的依附与控制,真正的实现了教育、学术、思想和文 化的独立。

当然,在这个时代,没有人会自命清高,认为“一纸文凭”不重要,以反动为铭志,但“校园自主”绝对不是荒唐的概念,这可追溯古代的学生运动;汉代始便有史书记载(约公元前206年),乃至宋明亦有典型事例。太学生及诸郡生徒为挽救封建统治的危机,以上书请愿,批判时政为主的高风亮节俯拾皆是。

学生要自主的真“相”

关于学生自主权,在我国还处在浅陋式“民间性”认识。国人往往从媒体而不是通过情感的觉识来认识它。其实,马来西亚的学生运动历史说来冗长,要交代《1971年大专法令》的靡靡之因,就像发霉的声响。

诚然,近年主流媒体在报道学生议题,跟在野党和暴动挂钩的画面比比皆是。由社会运动人看来,这是主流媒体不负责任的宣传;由那些懵然无知的学生看来,这仅仅 是一场暴动。我们又可以怎样去解决这种和民主阉割的宣传呢?恕我直言,爱好学生、社会运动的一群固然值得嘉许,但是他们多掺杂泛主义的概念,犹如宗教式的 象征,有吸引力但缺乏感召力。当然,这是关于组织性的问题,绝无批评之意。当然,讲了这一句话恐怕有要触犯许多人的忌讳,这是真相,应深自惕励。

行政机关和立法机关没有诚意

庸俗的论调指责《大专法令》有政治目的,倒不如说政府矫枉过正。年轻人失去反动的力量,渐成约定俗成的文化。1971年制定并通过了《大专法令》,只禁止在籍大学生成为政党或职工会的执行者,1975年变本加厉,由当时的教长马哈迪提呈,并由国会通过的《大专法令修正法令》,迅雷不及掩耳的剥夺了学生的结社权力,完全禁止任何校内外的政党、职工会或团体。

1983年第三度修订,严厉限制言论与结社自由,并遏制参与社会运动。第151) 条款,除非是由大学章程所规定的团体,或由校长书面批准的团体,大专生完全不被允许参与任何校内外的政党、职工会或团体。打个比方,如疑被鸡奸的赛夫布卡 里证实没被鸡奸,但要是当时他还是在籍学生,尽管计划败坏,其政党领袖助理的身份可以让《大专法令》提控,一旦罪成,刑罚是罚款马币一千元或监禁六个月或 两者兼施。

就最近呈上国会寻求通过的《大专法令》修正案,高教部长卡立诺丁还一副用心良苦狡辩,怕大专生从政后将会盲从党领袖的政策,但允许接触各政党,野党领袖可受 邀进入大学参与学术讨论。我说,部长先生所指“党领袖的政策”恐怕就少讲了一个“反”字,真是此地无银三百两。这些没有法律运作职权的政治人何必虎假虎威 占版位?就是“仁表妖里”!

另外,国人紧张一旦改朝换代,汽油是否会降价,但可别忘记当年进入秦国都城咸阳的刘邦,第一件事就是和秦人约法三章,其中重要的一章便是:悉除秦苛法,所以大专生组织的诉求千万不可局限于“国阵皇朝”。

“疏离政治”化

再者,《大专法令》第15条款违反《联邦宪法》公民基本自由条款,特别是第101)条款赋予的言论、集合与结社自由。人民也得开倒车窜改宪法,罢免已满21岁的大专生和教职员,不管投票有没有钱收,一律不准投票;小至12岁的孩子也不需申请身份证,因那张小卡是政治身份的认同。

政府时而依宪,时而违宪,马哈迪一早就“挑通眼眉”,预知国阵会一败涂地,看到风吹草动,就尽量榨取大学生和教职员身上里的主权,掩耳盗铃地去建构一个浑然天成的“疏离政治”症。“为什么要废除大专法令?”人人都称它让大专生变成“政治冷感”、“没有社会醒觉”,且不容他人置疑。

因此,“你凭什么认为自己有社会醒觉?”近期马来西亚社会因安华问题、阿尔丹杜雅而引发的“爱国问题,关心政治”的讨论,可是到底整件事情的来龙去脉,多少人真正在看?懂政治新闻的话又叫爱国?不必然。

至于大学的教职人员“人类的灵魂工程师”也应该检讨。培养孩子学习和独立思考,本质上本来就是不和谐的。在课堂上一定要讨论“敏感课题”,要知道这种疏离政 治的心态不是实现社会和谐的重要保障。试想当政治人、政府、法官、检察官、警官、律师在法律运作中都和谐一致,这岂能保障民主运作,又岂能有益于国家建设?

这个问题的关键还是回到:大部分的大专生“都不知道”所谓的社会责任。《大专法令》就像一个瘿瘤,败坏了一个细胞而引发恶性发炎的痈疽,从溃孔中排出,让他们患上“疏离政治”症。

现在进大学就读的孩子年纪最轻的有九字辈,领导学生运动的朋友应思考如何杀出重围,撇开政党的商标,以“吸引”隔离室的一群,绝不是推推挤挤地去标签他们。习惯了循规蹈矩的人,会接受不了,内心里渴望冲破世俗的规矩的人,会敬佩你们,但是否参与这群人又是一个问题。我说,既然选择走上“改革国体”这条路,不 但要自己走,还要将别人一起拉回来走,因为我们都在追求更多的个人自由。

政治的偷窥者

《大专法令》合理化执政者扮演偷窥者的角色,公私都成为“国家安全”的宰制,恰恰符合了近期流行的政治“阴谋”价值趋向,妄图偷窥每一位大专生隐私的部分。

马来西亚政府没有按照宪来保障大专生关心社会、参与社会的行为,违反法治精神,还谈什么司法公正?阿都拉巴达威还需要再益依布拉欣做场戏吗?就连年轻公民都无法自由权衡自己的利益,事事仰赖于官方的分配,这跟忍受紧箍箝制有什么不同?

听命于咒语调遣,把政府当作如来佛,给化身观音菩萨的大学领导一个金箍儿,钳紧了我们的脑袋。对,孙悟空痛苦不堪,无从反抗,但是它可以腾云驾雾,用一双金 睛火眼,看穿妖魔鬼怪伪装的伎俩。被打压时,或许还一个筋斗能翻十万八千里,使用的兵器如意金箍棒,能大能小,随心变化,还可以小到绣花针或者隐形呢!

“大专生”这个身份要如何大到顶天立地,上伸可到三十三重天,下伸可以至十八层地狱,是可以选择的,还好我们还有一个苏淑桦诉讼《大专法令》违宪的案例。

总结

毋庸置疑,或许大家一厢情愿认为,在野党在38日政治海啸后发挥了“神奇力量”,无形中可促成政府推动司法改革。再不客气地说一句,即使他们苟同要废除恶法又如何?争民心的竞争决定马来西亚的政治走向已经成为常态,他们的言论充其量“解放”了紧箍咒。

姑且撇开拟定法律的程序问题看问题:大家纷纷发文告、接受访问、也上报了,修正后的《大专法令》依然墨守成规。当然,实行民主政治和校园民主在本质上是同一种精神,但是在表现上,这两种运动却是分道扬镳的。

我们除了要有政治、社会醒觉、支持补选、上街示威、呈交备忘录、看本《野火集》,我们更要把这种精神留在笔尖上、留在长期的社区服务里。最后废恶法,弃恶 法,修正旧法定下良法是我们的路向,不是依靠让步妥协就能得来的,但是这是寻求行政机关和立法机关解决问题。问题的根源仅仅不怯于“受”是不够的,要真正 勇于“受”,我们需要更大勇气更需要更大的力量!

高教部长卡立诺丁表示一旦允许大专生参与政党,将阻碍大专生的全面发展和培养第一流的人力资源,我不同意这种说法。

高教部建议的大专法令 修改法案,看起来比原来的法令宽松,但却没有提出实质的改革。学生的宪赋自由与人权还是处处受到限制。例如说,不准参与和支持政党,不准参与和支持非法组 织,不准和支持参与高教部长禁止参与的团体(第15条(1)与(5);只允许针对就读的学术领域发言,只能在不是政党或非法组织赞助的活动上发言15条 (6)。

高等教育学府必须提倡独立思考,培养研究和创造知识的能力。因此剥夺大专生参与政治乃是打压国内异议的一种手段。

首相阿都拉在第十二届大选后曾声言推动改革,但是大专法令内的限制性条文继续存在,可见当权者和国阵害怕学生的力 量。阿都拉无疑将步前首相马哈迪医生后尘,后者在22年的掌权岁月中运用各种不同法律打压异议群体。

大专法令的制定和修改都含有政治目的,当权者在70年代镇压蓬勃的学生运动,但是打压行动反而激化了学生运动。当时的大专生支援打昔乌达勒的木屋区居民和胶工以及华玲饥民的抗议行动,是当权者决心对付学生运动,限制高等学府自由的导火线。

Universiti mesti mempertahankan semangat kebebasan dan pluralism

Saya tidak setuju terhadap kenyataan Menteri Pengajian Tinggi Datuk Seri Khaled Nordin bahawa pembangunan keseluruhan mahasiswa akan terbantut jika dibenarkan menyertai parti politik.

Rang undang-undang Akta Universiti dan Kolej Universiti yang dicadangkan oleh Kementerian tidak membawa perubahan asas. Peranan utama institute pengajian tinggi ialah mempromosikan pemikiran bebas dan kecekapan untuk memproses dan mencipta ilmu baru. Oleh yang demikian, tujuan mengkongkong kebebasan mahasiswa menyertai politik ialah untuk menghalang sebarang ketidaksetujuan dalam Negara.

Perdana Menteri Abdullah Badawi telah berjanji membawa pembaharuan selepas kekalahan teruk Barisan Nasional dalam pilihanraya ke-12. Pengharaman terus wujud dalam AUKU mencerminkan pihak berkuasa dan Barisan Nasional memang takut dengan kuasa gerakan mahasiswa. Ini juga menunjukkan Abdullah akan mengikuti langkah Dr. Mahathir Mohamad, seorang yang menggunakan pelbagai undang-undang untuk memadamkan perbezaan pendapat dalam 22 tahun pemerintahannya.

University must uphold the spirit of freedom and pluralism

I beg to differ with Higher Education Minister Datuk Seri Khaled Nordin that university students holistic development would be deterred if they were allowed to join political parties.

The proposed changes to the University and University Colleges ACT (UUCA) is purely cosmetic. The key role of institutions of higher learning is to promote independent thinking and the ability to process and create new knowledge. Therefore to clamp down on the freedom of students to partake in active politics is to curb any form of dissent in the country.

The Prime Minister Abdullah Ahmad Badawi’s rallying cry at the general election is to bring about reforms. But the stay on the ban reflects that the administration and Barisan Nasional fears student power. It is also clear that Abdullah is following in the footsteps of former premier Dr Mahathir Mohamad, whose 22 years in power was largely attributed to the use of various laws to thwart nonconformity.

It is common knowledge that the enactment and amendment of the University and University Colleges Act in 1971 were politically motivated to suppress vigorous student movement. However the assault on student movements only moved to further radicalize them. This is evident in the conviction by the students to stand by squatter dwellers and rubber tappers in the Tasik Utara (Johor) and Baling incidents, respectively.
